  1. PURPOSE OF THIS REQUEST FOR PROPOSALS

The purpose of the Request for Proposal (RFP) is to solicit sealed proposals to establish a contract through

competitive negotiations for the procurement of qualified, licensed, full-service, Law Firms to represent the

Buckman Direct Diversion Board (“the Board/BDDB”) in legal matters and litigation; provide legal services

and support to the BDD Board meetings and hearings and in court.

 

  1. BACKGROUND INFORMATION

The Buckman Direct Diversion Board “BDDB” an entity organized and existing under that certain Joint Powers

Agreement by and between the City of Santa Fe (“the City”) and Santa Fe County (“the County”), dated March

7, 2005, requests proposals from qualified attorneys to serve as legal counsel for the Board on matters related to

the Board’s provision of regional water resources though the Buckman Direct Diversion (“BDD”) Project.

 

  1. SCOPE OF PROCUREMENT

The required professional, legal services will cover, but are not limited to, general issues and concepts related to

public body organizational powers and duties, public policy review, contracting, opinion and agreement drafting

and negotiations, utility management and liability issues, and representation of the entity before federal and state

courts and governmental agencies.

This procurement will result in a contractual agreement between two parties; the procurement may ONLY be

used by those two parties exclusively as a single source award. The contractual agreement will commence

upon approval of the BDDB and when all parties sign. The Term will be (4) years based on the final

signature date of all parties.
